Thanks for the article as I love to take pictures. I had a problem at a public park once when taking pictures of my kids and some others playing. A mother had a fit because I was taking pictures of the kids. I was defiantly scared for some time not knowing if I was going to get a knock on the door from the police . Now I know I am not going to jail, as it was a public park.
Not all pictures of kid are Pornography contrary to –public opinion I have some very charming pictures but to scarred to post and others pictures do the fears of the public.

It has been my understanding is that the act of candid photo/videography and the images created constitute a protected form of speech in the U.S. As the rights PDF indicates, if a photo/videographer is lawfully present in a public place, it is his/her constitutional right to engage in the act of creating images, as long as the act and the images created don't otherwise violate law.
The definition of the forum in which the photo/videographer is present is very important. I understand there are three defintions of forum as concerns the citizens rights to engage in free speech: traditional, limited and non-public. For example, parks, streets and sidewalks constitute a traditional public forum: the state may not place limitations upon free speech in this forum in any way. In the limited forum the state may use time, place and manner restrictions on speech, but never restricting the speech based upon it's content. In a non-public forum, like the mayor's personal washroom, the state may restrict speech.
But all this is Constitutional. When you are staring a prejudiced cop in the eye who believes your taking a snap places you in the ammoral perv offender catagory, arguing that you have rights to take images granted and protected by the U.S. Constitution may not get you out of trouble. I've had local municipal law enforcement jurisdictions interpret my act of photo/videography as a violation of the codes disorderly conduct, disturbance, and loitering. I am confident however that if this issue were ever tested in a higher court, my first amendment rights would be interpreted as superior to the right of the city to restrict my conduct with these codes.
A little non-legal informal advice: if you are ever hostilely confronted and you have no cause that absolutely requires that you be present in that particular location, leave the presence of the person confronting you! Do so in a calm and controlled manner: running of may be interpreted as suspicious. I've had the old snoz rearranged and camcorder broken after engaging in dialog with someone who didn't like my activities, now I don't even bother with a response to the reactionary and ignorant public.
To be fair, I've never been arrested for candid photo/videography and the majority of my experiences with the public over the last six years have been very positive. I've created a great deal of quality material.
It's all worth it in the end. Some may not hold us or our works in high regard, but dammit, when that perfect shot comes through, I know it's definitely sublime art!
